1. Acceptance of Terms

By accessing and using StackScan ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this Service.

2. Use License

Permission is granted to use StackScan for security scanning of websites that you own or have explicit permission to scan. This is the grant of a license, not a transfer of title, and under this license you may not:

  • Scan websites without proper authorization
  • Use the Service for any illegal purposes
  • Attempt to gain unauthorized access to any systems
  • Interfere with or disrupt the Service or servers
  • Share your account credentials with unauthorized users

3. Account Terms

You must be 18 years or older to use this Service. You must provide your legal full name, a valid email address, and any other information requested in order to complete the signup process.

You are responsible for maintaining the security of your account and password. StackScan cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.

4. Payment Terms

A valid payment method is required for paid plans. You will be charged on a recurring basis according to your selected plan (monthly). All fees are exclusive of all taxes, levies, or duties imposed by taxing authorities, and you shall be responsible for payment of all such taxes, levies, or duties.

We use third-party payment processors (PayPal). By providing a payment method, you agree to their respective terms of service.

5. Cancellation and Termination

You are solely responsible for properly canceling your account. You can cancel your subscription at any time through your account settings or via the payment processor directly (PayPal). Cancellation will take effect at the end of your current billing period.

We reserve the right to suspend or terminate your account and refuse any and all current or future use of the Service for any reason at any time, including but not limited to violation of these Terms.

6. Service Availability

We strive to provide a reliable service but do not guarantee that the Service will be uninterrupted or error-free. We reserve the right to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice.

7. Limitation of Liability

In no event shall StackScan, nor its parent companies, directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Service
  • Any conduct or content of any third party on the Service
  • Any content obtained from the Service
  • Unauthorized access, use or alteration of your transmissions, content or data

8. Disclaimer

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. StackScan makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

9. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of StackScan and its licensors. The Service is protected by copyright, trademark, and other laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Service without prior written consent.

10. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. Please review our Privacy Policy, which also governs the Site and informs users of our data collection practices.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
